Terms and conditions

Sportscience.com provides a customized subscription service that allows its subscribers to access Events, Series and Video Courses (“Sport Science Content”) streamed via the Internet, through certain televisions with Internet connection, computers and other devices (“Devices compatible with Sportscience.com”). These Terms of Use govern your use of our service. Within these Terms and Conditions of Use, for “Sportscience.com service”, “our service” or “service” means the personalised service provided by Sportscience.com for the selection and viewing of content, including the use and functionality of the 3D Biodigital Human Anatomy, articles, website and user interfaces, as well as all content and software associated with our service.

1.1. Your subscription to Sportscience.com will continue until you cancel. In order to use the Sportscience.com service, you must have Internet access and a device compatible with Sportscience.com; you must also provide one or more Payment Methods. “Payment Method” means a current, valid and accepted payment method that can be updated periodically and include payments to your account via a third party. Unless you cancel your subscription before the relevant billing date, you authorize us to charge the subscription fee for the next billing cycle to your chosen payment method (see the “Cancellation” section below).

1.2. Sportscience.com currently offers a basic subscription plan. You can find specific information about your subscription by clicking on “Account” and “Subscription”, available at the top of the pages, under the name of your profile. Promotional offers. Occasionally, we may offer plans, subscriptions or special promotional offers (“Offers”). Sportscience.com determines in its sole discretion eligibility for Offerings and we reserve the right to revoke an Offer and suspend your account if it is determined that you are no longer eligible for the Offer. To determine eligibility for the Offering, we may use information such as your device ID, payment method, or an email address used with your existing or recently activated Sportscience.com subscription. Eligibility requirements and other limitations and conditions shall be disclosed to you upon subscription to the Offering or by other means of communication.

3.1. Billing cycle. The subscription fee of the Sportscience.com service will be charged to your Payment Method on the specific payment date indicated on the “Account” page. In some cases, the payment date may vary, for example, if your Payment Method was not charged or your subscription started on a day not present in a given month. To view the date of the next payment, visit our website and click on the “billing” link on the “Account” page.

3.2. Payment methods. To use the Sport Science service you must indicate one or more Payment methods. You authorize us to charge any Payment Method associated with your account if your Primary Payment Method is declined or cannot be used to pay your subscription fee. You will be responsible for any outstanding amounts. If a charge fails due to the expiration of the Payment Method, insufficient funds or for any other reason, and if you did not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method.

3.3. Updating Payment Methods. You can update Payment Methods on the “Account” page. We may update your Payment Methods based on data received from payment service providers. After each upgrade, you authorize us to continue charging for available Payment Methods.

3.4. Cancellation. You can cancel your subscription to Sport science.com at any time by continuing to have access to the Sportscience.com service until the end of the billing period. Payments are non-refundable and we do not grant refunds or credits for partially used subscription periods or for unused Sportscience.com content. To cancel your subscription visit the “Account” page and follow the cancellation instructions. If you cancel your subscription, your account will be automatically closed at the end of the current billing period. To check the closing date of your account, click on “Billing” on the “Account” page. If you have registered with Sportscience.com using your Payment Method account with a third party and wish to cancel your subscription to Sportscience.com, you may have to cancel your subscription through that third party, for example by accessing your account settings with that third party and disabling the auto-renewal option or cancelling the Sportscience.com service through that third party.

3.5. Price and subscription plan changes. From time to time we may change our subscription plans and the price of our service; however, any changes to the price or subscription plans will take effect no earlier than 30 days from the date we send you the relevant notice.

4.1. To subscribe to Sportscience.com you must be at least 18 years old. Minors may use the service only under the supervision of an adult.

4.2. The Sportscience.com service and any content displayed through the service is for personal, non-commercial use only and may not be shared with other persons. During the lifetime of your Sportscience.com subscription, we grant you a limited, non-exclusive, non-transferable right to access the Sportscience.com service and view Sportscience.com content. Except as above, no other rights, title or interest will be transferred to you. You agree not to use the service for public screenings. The same indications have the same value for the use of the Human Anatomy Biodigital 3d Anatomical Atlas, for which any use other than strictly personal is expressly prohibited.

4.3. The Sportscience.com service and the content library are updated regularly. In addition, we continuously test various aspects of our service, including our website, user interfaces, promotional features and the availability of Sportscience.com content.

4.4. You agree not to retain, reproduce, distribute, modify, display, publish, license, create derivative works from, offer for sale or use (except where expressly authorized in these Terms of Use) content and information about the Sportscience.com service or obtained from or through the Sportscience.com service. You also agree not to: bypass, remove, alter, disable, degrade or block content protections in the Sportscience.com service; use robots, spiders, scrapers or other automated tools to access the Sportscience.com service; decompile, reverse engineer or disassemble any software or other product or process accessible through the Sportscience.com service; enter any code or product or manipulate the content of the Sportscience.com service in any way; or use any method of data mining or data collection or extraction. You also agree not to upload, post, email or otherwise send or transmit any material designed to interrupt, destroy or restrict the functionality of any computer software or hardware or telecommunications terminal associated with the Sportscience.com service, including viruses and any other computer code, file or program. We may restrict or terminate your use of our Service if you violate these Terms of Use or use our Service unlawfully or fraudulently.

4.5. The quality of Sportscience.com content display may vary depending on your device and may be affected by a number of factors, such as your geographic location, available bandwidth or the speed of your Internet connection. The availability of HD, Ultra HD and HDR formats depends on the Internet service you use and the characteristics of the device used. Not all content is available in all formats, such as HD, Ultra HD and HDR, and not all subscription plans allow you to receive content in all formats. The default settings for playing over cellular networks exclude content in HD, Ultra HD and HDR. The minimum connection speed required for standard definition viewing is 1.0 Mbps; however, we recommend a faster connection for better video quality. A download speed of at least 3.0 Mbps per stream is recommended to receive HD content (720p resolution or higher). A download speed of at least 15.0 Mbps per stream is recommended to receive Ultra HD content (4K resolution or higher). All Internet access costs will be borne by you. Please check for any data usage charges with your Internet provider. The time it takes to start watching Sportscience.com content may vary based on a number of factors, including your geographic location, the bandwidth available at the moment, the content you have selected and the device configuration compatible with Sportscience.com.

4.6. The software of Sportscience.com is developed by and on behalf of ATS and Giacomo Catalani Editore and can be used exclusively for streaming and authorized viewing of Sportscience.com content through compatible devices. This software may vary depending on the device and means of use and the features and functions may differ depending on the device. You acknowledge that use of the service may require third-party software subject to third-party licenses. You agree that you will automatically receive updated versions of Sportscience.com and third-party software. Password and account access. The subscriber who created the Sportscience.com account and whose Payment Method is charged (“Account Holder”) is responsible for any activity that takes place through the Sportscience.com account. In order to maintain control of your account and prevent anyone from accessing your account (and thus also account view history information), the Account Holder must maintain control of the devices compatible with Sportscience.com, used to access the service, and must not communicate to anyone the password or details of the payment method associated with the account. It will be your responsibility to update the information you provide to us about your account and ensure that it is accurate. We may close or suspend your account in order to protect you, Sportscience.com or our partners from identity theft or other fraudulent activity.

6.1. Current legislation. These Terms of Use shall be governed by and construed in accordance with Italian law. These Terms do not limit the consumer rights that you may hold under the mandatory rules of your country of residence.

6.2. Materials not required. Sportscience.com does not accept unsolicited materials or ideas for Sportscience.com content and is not responsible for the similarity of any of its content or programs on any media with respect to materials or ideas transmitted to Sportscience.com.

6.3. Customer Support. For more information about our service and its features or if you need assistance with your account, please visit the Sportscience.com Help Desk and Support area on our website. In some cases, Customer Service may better assist you by using a remote access assistance tool, through which we will have full access to your computer. If you do not wish to grant us such access, please do not consent to assistance through the remote access tool and we will assist you by other means.

6.4. Validity. If one or more provisions of these Terms of Use are found to be invalid, illegal or unenforceable, this will not affect the validity, legitimacy and enforceability of the remaining provisions, which will continue to be fully valid and effective.

6.5. Changes to the Terms of Use. Sportscience.com may periodically modify these Terms of Use.

6.6. Electronic communications. We will send you information related to your account (for example, payment permissions, invoices, password or payment method changes, confirmation messages, notifications) in electronic format only, for example by email to the email address you provided to us at the time of registration.
